1. Agreement to These Terms

These Terms of Service ("Terms") govern your use of Bad Times Video AI (badtimesvideoai.com, the "Service"), operated by Bad Times Video AI ("we", "us"). By creating an account, uploading a photo, generating a video, purchasing credits, or otherwise using the Service, you agree to these Terms and to our Privacy Policy.

If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization — in that case, "you" means both you and the organization.

If you do not agree with these Terms, do not use the Service.

2. The Service

Bad Times Video AI turns one photo of your pet, baby, child or yourself into an AI-generated video in the "Bad Times" trend format:

• a 15-second, vertical 9:16 MP4 with sound;
• in one of two versions: Pet (dogs and cats) or Baby & people;
• previewable online and downloadable.

Each generation consumes 40 credits. Credits are sold in packs.

We may change, suspend, or discontinue features of the Service from time to time, with reasonable notice where the change materially reduces what you have already paid for.

3. Eligibility

• You must be at least 16 years old (or the minimum age of digital consent in your country, which may be 13) to use the Service.
• Purchases require you to be 18 or older, or to have the involvement of a parent or guardian who agrees to these Terms.
• If you are a parent or guardian, you are responsible for the child's use of the Service and for any content you upload on their behalf.

4. Your Account

• Provide accurate information and keep it up to date.
• You are responsible for your sign-in credentials (email/password or your Google account) and for all activity under your account.
• Notify us promptly at support@badtimesvideoai.com if you suspect unauthorized use.
• One account per person.

5. Credits, Payments and Refunds

• Credits. One video generation costs 40 credits. Credit-pack prices are shown at checkout and may change for future purchases. Credits do not expire and have no cash value — except where required by law, or where we issue a refund.
• Payments. Purchases are processed by third-party payment providers (such as Stripe). You authorize us and the provider to charge the payment method you select for the pack price plus applicable taxes.
• Failed generations are refunded automatically. If a generation fails, the 40 credits are returned to your account automatically — no support ticket needed.
• Other refunds. Except where required by law (including any mandatory withdrawal rights for consumers in your country), purchases of credits are final once used. If you have a problem with a purchase, contact support@badtimesvideoai.com and we will work in good faith to resolve it.

6. Your Content and Rights

• You keep ownership. You retain all rights to the photo you upload and to the videos generated for you.
• You grant us a limited licence to host, copy, transmit and display your content solely to operate the Service — running the AI generation, storing and delivering your video, showing it in your history, and keeping backups. This licence ends when the content is deleted.
• We do not train AI on your content. Your photos and videos are not used to train machine-learning models, and we require our AI providers not to train on them either.
• Your photos must be yours to use. Before uploading, you confirm that:
  • you own the photo or have permission from its owner;
  • every person recognizably appearing in it (or their parent/guardian, for children) has agreed to this use;
  • the photo does not infringe anyone's privacy, publicity, or other rights.

This matches the confirmation you give at generation time: "I agree to the Terms & Privacy. I confirm I own rights to the uploaded photo."

7. Acceptable Use — Zero Tolerance

You may not use the Service to create, upload, or distribute content that:

1. Depicts a minor in any sexualized, nude, or exploitative way — zero tolerance. We will remove the content, ban the account, and report to law enforcement and child-protection authorities (e.g. NCMEC / INHOPE).
2. Depicts a real person in a deceptive or harmful way without their consent — including non-consensual intimate content, fake statements, defamatory or humiliating depictions, and impersonation of real individuals, public figures, or private persons.
3. Is illegal, promotes violence or hatred, harasses or bullies individuals, or encourages self-harm or criminal activity.
4. Infringes intellectual property or personality rights — photos, likenesses, or characters you have no right to use.
5. Facilitates fraud, scams, or misleading claims — including passing AI-generated videos off as authentic evidence or news.
6. Attempts to reverse engineer, scrape, resell, or abuse the Service, bypass rate limits or credit systems, probe security, or access other users' content.
7. Uploads content you have no legal basis to process.

We may investigate, remove content, suspend or terminate accounts that violate these rules, and report unlawful content where required.

8. AI-Generated Content

• The videos are synthetic, AI-generated media. The animation, likeness and performance are artificial; results vary and may not perfectly resemble the subject.
• Disclose AI origin where it matters. When you post a generated video on platforms that require synthetic-media labeling (including under the EU AI Act or platform policies), you are responsible for applying the required disclosure.
• Do not use the Service for deceptive purposes — fake endorsements, fabricated events, or misleading claims about real people or facts.

9. Posting on Other Platforms

Generated videos are yours to share, but posting to TikTok, Instagram Reels, YouTube Shorts or any other platform is subject to that platform's terms and to music/audio licensing rules. The audio track bundled with the video is provided as part of the trend format; we do not grant you rights to third-party music beyond our own licences, and your use of videos on other platforms is at your discretion and risk.

10. Our Intellectual Property

The Service — software, design, brand ("Bad Times Video AI"), and all related intellectual property — belongs to us or our licensors. These Terms do not grant you any right to use our branding except as needed to refer to the Service. If you send us feedback or suggestions, we may use them without obligation to you.

11. Suspension and Termination

• You may stop using the Service at any time and can delete your account from your profile or by contacting support.
• We may suspend or terminate access for breach of these Terms, suspected fraud or abuse, legal requirements, or prolonged inactivity. Where reasonable, we will notify you and give you the chance to export your videos first.
• On termination, your licence to use the Service ends; provisions that by nature should survive (including Sections 6, 8, 10, 12, 13 and 14) will survive.

12. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties — express or implied — of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that generation will always succeed, that results will meet your expectations, or that the Service will be uninterrupted or error-free.

Nothing in these Terms excludes rights you have as a consumer that cannot be excluded by law.

13. Limitation of Liability

To the fullest extent permitted by law:

• We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or reputational harm.
• Our total aggregate liability arising out of or relating to the Service is limited to the greater of (a) the amounts you paid us for credits in the 12 months before the claim, or (b) USD 50.

14. Indemnity

You agree to indemnify and hold us harmless from claims, losses and expenses (including reasonable legal fees) arising out of your content, your use of the Service in violation of these Terms, or your infringement of anyone's rights.

15. Governing Law and Disputes

• These Terms are governed by the laws of the jurisdiction in which the Service operator is established, without regard to conflict-of-law rules — without limiting mandatory consumer protections you enjoy under the laws of your country of residence.
• Before filing a claim, please contact support@badtimesvideoai.com so we can try to resolve the issue informally. Most concerns are resolved quickly.

16. Changes to These Terms

We may update these Terms as the product evolves. Material changes will be posted here with a new "updated" date and, where appropriate, notified by email or in the product. Continuing to use the Service after changes take effect means you accept the revised Terms.
